The 88 stations case was a 1935–40 controversy and court case involving the Old Colony Division of the New York, New Haven and Hartford Railroad. The New Haven entered bankruptcy in 1935; the next year, it ended the 1893 lease of the unprofitable Old Colony Division, but continued operating those lines by court order. The Old Colony and New Haven closed 88 stations in Massachusetts (plus five in Rhode Island) on July 18, 1938, ending passenger service altogether on some lines. In May 1939, the Old Colony filed to abandon all freight and passenger service on its lines. In November 1939, the Supreme Court of the United States ruled in Palmer v. Massachusetts that a district court did not have authority to order the discontinuance of intrastate passenger service.

Schneider v. State of New Jersey, 308 U.S. 147 (1939), was a United States Supreme Court decision that combined four similar appeals (Schneider v. State of New Jersey (Town of Irvington), Young v. People of the State of California, Snyder v. City of Milwaukee, Nichols et al. v. Commonwealth of Massachusetts), each of which presented the question whether regulations embodied in municipal ordinances abridged the First Amendment rights of freedom of speech and of the press secured against state invasion by the Fourteenth Amendment of the Constitution. The appellants (Jehovah's Witnesses) were charged with a violation of a local ordinance that barred persons from distributing handbills on public streets or handing them out door-to-door.

Held: that the Commission was without the authority of any act of Congress to attach the prescribed conditions to its order. Consequently, they argue that the courts may appropriately set them aside as of no effect, leaving the remainder of the order to stand as the Commission’s unqualified approval of the lease, although the Commission gave no indication that it would have authorized the lease without the conditions.

Nardone v. United States, 308 U.S. 338 (1939), was a U.S. Supreme Court case in which the Court ruled that evidence obtained via warrantless wiretaps, in violation of the Communications Act of 1934, was inadmissible in federal court. The Court ruled that use of evidence directly obtained from wiretapping, such as the conversations themselves, and indirectly, such as evidence obtained through knowledge gained from wiretapped conversations, was inadmissible in trial court.
