McGoldrick v. Berwind-White Coal Mining Co., 309 U.S. 33 (1940), is United States Supreme Court case upholding the legality under the Constitution's Commerce Clause of a tax by the City of New York upon the purchase of coal by public utility and steamship companies based in New York from Berwind-White Coal Mining Company, a Pennsylvania coal company through its New York office.

The bank’s president, knowing that such acquisition of its own stock was an illegal dissipation of its capital, worked out an ostensible sale of the stock for a note which it was understood was to be placed amongst the assets of the bank for the purpose of deceiving the examiners. The note was without consideration and the understanding was that it would not be collected.

Sheldon v. Metro-Goldwyn Pictures Corp., 309 U.S. 390 (1940), was a United States Supreme Court case in which the Court held, in the case of an unauthorized adaptation, courts may elect to award only a portion of an infringer's profits to the plaintiff. The proportion that the defendant is entitled to keep is in proportion to the amount of original creative work that went into the adaptation, and the court may be assisted in determining that by expert witness testimony. The Court found that awarding more to the plaintiff "would be to inflict an unauthorized penalty." The case involved Metro-Goldwyn using material from the 1930 play Dishonored Lady by Edward Sheldon and Margaret Ayer Barnes for the 1932 film Letty Lynton.

Ethyl Gasoline Corp. v. United States, 309 U.S. 436 (1940), was a decision of the United States Supreme Court that limited the doctrine of the Court's 1938 decision in General Talking Pictures Corp. v. Western Electric Co. Beginning with the 1926 decision in United States v.

Helvering v. Bruun, 309 U.S. 461 (1940), was an income tax case before the Supreme Court of the United States. It is notable (and thus appears frequently in law school casebooks) for holding that under section 22(a) of the Revenue Act of 1932, income need not be in the form of cash for it to be taxable. Gain may occur as a result of exchange of property, payment of the taxpayer's indebtedness, relief from a liability, or other profit realized from the completion of a transaction.

Federal Communications Commission v. Sanders Brothers Radio Station, 309 U.S. 470 (1940), was an early precedent on the enforcement of broadcasting law in the United States. The Supreme Court held that when the Federal Communications Commission (FCC) makes spectrum allocation decisions regarding the use of broadcast frequencies by radio stations, such decisions should be made to serve the public interest, convenience, and necessity as defined by the Communications Act of 1934. Consequently, such decisions by the FCC do not need to consider the profitability or business interests of the companies assigned such frequencies, or those of their competitors.
