<center> SYLLABUS BY THE COURT</center>1. HABEAS CORPUS — <italic>Petitioner in K.S.A. <cross_reference>60-1507</cross_reference> Proceeding Has Statutory</italic> <italic>Right to Effective Assistance of Counsel.</italic> A K.S.A. <cross_reference>60-1507</cross_reference> proceeding is a civil action for which there is no constitutional right to effective assistance of counsel. However, Kansas law provides a statutory right to effective assistance of counsel in a K.S.A. <cross_reference>60-1507</cross_reference> proceeding. 2. ATTORNEY AND CLIENT — <italic>Rules of Professional Conduct — Attorney Owes</italic> <italic>Duty of Candor to Court.</italic> Under Kansas Rule of Professional Conduct 3.3 (2005 Kan. Ct. R. Annot. 462), counsel owes a duty of candor toward the court and cannot offer evidence counsel knows to be false or make arguments counsel knows have no merit. 3. HABEAS CORPUS — <italic>Petitioner in K.S.A. <cross_reference>60-1507</cross_reference> Proceeding Has Statutory</italic> <italic>Right to Effective Assistance of Counsel — Movant's Statutory Right Not</italic> <italic>Violated under Facts of Case.</italic> Under the facts of this case, the movant's statutory right to effective assistance of counsel in the K.S.A. <cross_reference>60-1507</cross_reference> proceeding was not violated. 4. SAME — <italic>Evidentiary Hearing on K.S.A. <cross_reference>60-1507</cross_reference> Motion — When Required.</italic> The district court shall hold an evidentiary hearing on a K.S.A. <cross_reference>60-1507</cross_reference> motion and make findings of fact and conclusions of law with respect thereto, unless the motion and the files and records of the case conclusively show the prisoner is not entitled to relief. The burden is on the movant to allege facts sufficient to warrant a hearing on the motion. 5. SAME — <italic>Summary Denial of K.S.A. <cross_reference>60-1507</cross_reference> Motion — Appellate Review.</italic> On appeal, a district court's summary denial of a K.S.A. <cross_reference>60-1507</cross_reference> motion is reviewed for abuse of discretion. If the motion alleges facts not in the original record that would, if true, entitle the movant to relief, and if readily available witnesses are identified whose testimony would support those facts, it is error for the district court to summarily deny the motion without holding an evidentiary hearing. 6. SAME — <italic>Allegations of Ineffective Assistance of Trial Counsel Raised</italic> <italic>in K.S.A. <cross_reference>60-1507</cross_reference> Motion — Preliminary Review of Motion Usually Mad by</italic> <italic>Trial Judge</italic> — <italic>Trial Judge's Finding Entitled to Deference.</italic> Ordinarily the trial judge is expected to make the preliminary review of a K.S.A. <cross_reference>60-1507</cross_reference> motion to decide if an evidentiary hearing should be conducted, because of his or her familiarity with the underlying criminal case. When this procedure is followed, the district<page_number>Page 807</page_number> court's findings concerning the trial counsel's performance are entitled to deference. 7. APPEAL AND ERROR — <italic>District Court Decision Upheld on Appeal if Right</italic> <italic>Result But Based on Wrong Reason.</italic> If the district court reaches the right result, its decision will be upheld even though the district court relied upon the wrong ground or assigned erroneous reasons for its decision.
