<center> SYLLABUS BY THE COURT</center>1. APPEAL AND ERROR — <italic>Suppression of Evidence — State's Burden to Show</italic> <italic>lawfulness of Search — Appellate Review of Motion to Suppress When Case</italic> <italic>Submitted on Stipulated Facts.</italic> The State has the burden of establishing the lawfulness of a search and seizure. When a case is submitted on stipulated facts, the question of whether to grant or to deny a motion to suppress is a question of law subject to unlimited review. 2. SEARCH AND SEIZURE — <italic>Terry Stop — Frisk of Person by Law Enforcement</italic> <italic>Officer — Limitation of Protective Search.</italic> During a stop under <italic>Terry</italic> <italic>v. Ohio</italic>, <cross_reference>392 U.S. 1</cross_reference>, <cross_reference>20 L. Ed. 2d 889</cross_reference>, <cross_reference>88 S. Ct. 1868</cross_reference> (1968), and K.S.A. <cross_reference>22-2402</cross_reference>, a law enforcement officer is allowed to frisk a person seized for weapons if the officer reasonably suspects that his or her personal safety requires it. Nevertheless, this protective search must be limited to that which is necessary for the discovery of weapons which might be used to harm the officer or others nearby. A general exploratory search for evidence of criminal activity is not a permissible purpose. 3. SAME — <italic>Reasonable Suspicion of Law Enforcement Officer That Crime</italic> <italic>Committed or about to Be Committed — "Reasonable Suspicion" Examined by</italic> <italic>Court.</italic> A court considers an officer's reasonable suspicion in light of the totality of the circumstances. 4. SAME — <italic>Consent to Search — Voluntariness of Consent When Search</italic> <italic>Preceded by <cross_reference>Fourth Amendment</cross_reference> Violation.</italic> When a consent to a search is preceded by a violation of the <cross_reference>Fourth Amendment to the United States Constitution</cross_reference>, the State, in addition to proving the voluntariness of the consent, must also establish a break in the causal connection between the illegality and the evidence thereby obtained. 5. SAME — <italic>Request for Consent to Search Simultaneous with Illegal</italic> <italic>Pat-down Search — Consent Deemed Not Voluntary as Matter of Law —</italic> <italic>Suppression of Evidence Required.</italic> When a request for consent is virtually simultaneous with an illegal pat-down search and there is no break in the activity between the pat-down searcli and the consent, the consent is not voluntary as a matter of law, and the evidence must be suppressed as fruit of the poisonous tree under Wong <italic>Sun v. United</italic> <italic>States</italic>, <cross_reference>371 U.S. 471</cross_reference>, <cross_reference>9 L. Ed. 2d 441</cross_reference>, <cross_reference>83 S. Ct. 407</cross_reference> (1963).
