¶1Appellate jurisdietion.
¶2An appeal lies from the district court of the United States, for the territory of Orleans, tc this court.
¶3Appeal from tbe District Court of tbe United States for tbe territory of Orleans, in a suit in equity.
¶4That court was established by tbe act of congress, of 26th March 1804, § 8 (1 U. S. Stat. 285), and has a jurisdietion similar to that given to tbe district court of tbe United States for tbe district of Kentucky.
¶5This Court was of opinion, that an appeal lies from that court to this ; but that in this case, tbe court below bad not jurisdiction, because it did not appear that tbe parties were citizens of different states, nor aliens, &c., so as to give them a right to litigate in tbe courts of tbe United States.
