¶1Concurring Opinion by

Mr. Justice Roberts :

¶2I agree that appellant is entitled to a new trial because the trial court, over timely objection, erroneously permitted the prosecutor to call witnesses who the prosecutor knew would assert the privilege against self-incrimination.

¶3In view of the grant of a new trial on the above ground, I fail to see the need or wisdom in presently discussing—as does the majority—the admissibility of either appellant’s statement or the color slides. If in the future these issues are presented to the Court and are necessary for decision, that will be the appropriate time for resolution of those issues.
