[1] MUNICIPAL CORPORATIONS — TORTS — EXERCISE OF GOVERNMENTAL POWERS — SUPERVISION AND CONTROL OF STREETS. The setting aside by a city of a portion of one of its streets for sledding and the directing of traffic thereon are acts of supervision and control and not of maintenance, and in the ownership, control, and supervision of its streets a city acts in its governmental and not in its proprietary capacity and it is immune from liability for negligence in the performance of such functions; hence, assuming that the city was negligent in failing to clear the street so set aside of parked vehicles, this was negligence for which the city could not be held liable. [2] SAME — NUISANCE — LIABILITY OF CITY. Governmental immunity does not extend to the creation or maintenance of a nuisance, even though in creating or maintaining such nuisance the city is exercising a governmental function. [3] SAME. A city may not be liable for injuries resulting from a neglect of duty on the part of its employees in failing to enforce its ordinances. [4] SAME. There is in this state no statutory duty imposed upon a city to keep its streets free from nuisance; and if a car which was parked for more than twenty-four hours became a nuisance as defined by city ordinance, it was not one for which the city can be held liable, since the city neither created or maintained it, and if it "permitted" its existence it did so only in so far as its employees negligently failed to enforce its own ordinance.
