<bold>[1] Covenants — Construction — In General.</bold> Covenants restricting the use of real property by the grantee are to be construed strictly against the grantor and those claiming the benefits of the restrictions; they will not be extended beyond the clear meaning of the language used. <bold>[2] Covenants — Use of Realty — Buildings — Sideline</bold> <bold>Restriction.</bold> Where an owner has acquired a plot comprising more than one contiguous lot, which lots are individually subject to sideline building restrictions, and seeks to build in such a manner as to overlap what would be the sidelines if the lots were owned separately, the building restrictions apply only to the outside lines of the plot regardless of how many platted lots it includes. <bold>[1] Divorce — Custody of Children — Modification Distinguished</bold> <bold>From Clarification.</bold> A <italic>modification</italic> of visitation provisions of a divorce decree is to be distinguished from a <italic>clarification</italic> in that a modification occurs where the visitation rights given to one of the parties is either extended beyond the scope originally intended or where those rights are reduced, giving a party less rights than originally received, and a clarification is merely a definition of those rights already given. <bold>[2] Divorce — Custody of Children — Basis for Modification or</bold> <bold>Clarification.</bold> A modification of visitation rights in a divorce decree is granted only where there has been a material change in the condition or fitness of the parties or the welfare of the children would be promoted thereby; however, a clarification requires no change in circumstances. <bold>[3] Divorce — Custody of Children — Clarification — "Reasonable</bold> <bold>Visitation Rights."</bold> An order stating that a divorced parent was to have visitation rights on alternate weekends and one evening a week, based on a divorce decree providing for "reasonable visitation rights," constituted a clarification of the decree and not a modification. <bold>[4] Motions — Facts Not of Record — Oral Testimony — Discretion</bold> <bold>of Court.</bold> Whether or not the trial court orders oral testimony to be given, pursuant to CR 43(e)(1), in situations involving motions based on facts not appearing of record, is a matter for its discretion. Its ruling will not be disturbed unless a manifest abuse of such discretion is shown. <bold>[5] Motions — Notice — Sufficiency — Waiver.</bold> A party receiving notice of a hearing on a motion which notice did not comply with the time requirement of CR 6(d) waived the defect, where he filed affidavits in resistance to the motion, did not request a continuance, and did not raise the issue of adequate notice at the hearing.
