<bold>[1] Criminal Law — Confessions — Voluntariness — Intoxication.</bold> The fact that a defendant was intoxicated, and had been arrested for being intoxicated in public, prior to making incriminating statements to law enforcement officers did not render testimony as to the statements inadmissible where the circumstances at the time the statements were made were such that the defendant understood what was being said to him and understood Miranda warnings which had been given him. In such a situation evidence of the intoxication of the defendant is admissible as going to the weight and credibility of the evidence of self-incrimination, and the jury should be instructed to disregard any admissions of the defendant that it finds to be involuntary. <bold>[1] Criminal Law — Evidence — Identification — Showing of</bold> <bold>Photograph Prior to In-court Identification.</bold> The showing of a picture of an accused for purposes of identification will not render a later in-court identification of him inadmissible unless the photographic identification procedure was so impermissibly suggestive as to give rise to a substantial likelihood of irreparable misidentification. <bold>[2] Criminal Law — Evidence — Lineup.</bold> An in-court identification following identification in a police lineup is constitutionally permissible so long as the lineup was not conducted as to render the accused unduly conspicuous in it, or anything is done rendering it so suggestive as to give rise to a substantial likelihood of irreparable misidentification. <bold>[3] Criminal Law — Evidence — Subjects Opened by Adverse Party.</bold> When a subject is opened by a party on direct or cross-examination, the other party may cross-examine or examine on redirect within the scope of the examination in which the subject matter was first introduced. <bold>[4] Appeal and Error — Review — Issues Not Raised in Trial</bold> <bold>Court.</bold> An alleged error must be asserted at trial in order to obtain review on appeal, unless it is of such extreme, flagrant and prejudicial nature as to make curative measures futile, or there has been a course of conduct so persistently prejudicial as to constitute a denial of due process of law.
