<bold>[1] Schools and School Districts — Teachers — Discharge — Record</bold> <bold>on Appeal.</bold> Under RCW 28A.58.470, which describes the record a school board must furnish upon a judicial review of a teacher's discharge as including a "transcript of the evidence," the record must contain a transcript of all the oral proceedings as well as all papers and exhibits relating to the decision. <bold>[2] Schools and School Districts — Teachers — Discharge —</bold> <bold>Judicial Review.</bold> The trial court's determination made during a review conducted under the provisions of RCW 28A.58.480 respecting the discharge of a teacher must be arrived at by an independent examination of the facts unhampered by the findings and conclusions of the school board. <block_quote> [See Ann. 110 A.L.R. 791, 808, 113 A.L.R. 1495, 1502, 127 A.L.R. 1298, 1330; 47 Am. <bold>[1] Insurance — Duty to Defend Suit — In General.</bold> An insurer who has assumed the duty to defend suits, must defend an action only when the allegations, if proven, would render the insurer liable. [See Ann. 50 A.L.R.2d 458; 44 Am.Jur.2d, Insurance § 1539.] <bold>[2] Consumer Protection — Unfair Competition — Injunctive Relief</bold> <bold>— Nature of Action.</bold> An injunctive action by the state, under the Consumer Protection Act (RCW 19.86) alleging that the defendant is guilty, <italic>inter alia</italic>, of "unfair competition," is for the benefit of the public at large, and not the defendant's competitors. BRACHTENBACH, J., did not participate in the disposition of this case.
