¶1It was impossible for the witness to identify a note which was not before him. He had nothing to swear by but a copy, and even that was an imperfect one. The original ought to have been before him, and recognised by him. Besides, the interrogatories were not attached; and the court could not say whether the answers were pertinent to them.
¶2Judgment affirmed.
