<bold>[1] Criminal Law — Plea of Guilty — Plea Bargaining — Habitual</bold> <bold>Criminal Status — Review.</bold> A guilty plea entered pursuant to a plea bargain in which the accused agrees to waive the right to appeal precludes review of any nonjurisdictional issue involving the sufficiency of an information charging a crime or habitual criminal status as long as the accused was aware of the<page_number>Page 355</page_number> consequences of the waiver and there was a manifest factual basis for the plea.

The burden of overcoming this presumption rests heavily upon the challenger. <bold>[2] Constitutional Law — Gift of Money or Credit — Valuable</bold> <bold>Consideration.</bold> Receipt of valuable consideration prevents the payment of public funds from being a gift within the meaning of Const. art. 8, § 7. <bold>[3] Property — Development Rights — Nature of Right.</bold> The right to use and subdivide land for residential, commercial, or industrial purposes is an interest in property and a valuable right. <bold>[4] Statutes — Construction — Prior Enactments — Effect.</bold> Legislative bodies, including the electorate acting in a legislative capacity, are presumed to be familiar with existing statutes affecting the matter upon which they are legislating. <bold>[5] Municipal Corporations — Bonds — Interest Rate — Voter</bold> <bold>Approval — Effect.</bold> A bond issue authorized at an election may not be sold at a higher interest rate than that approved by the voters.

<bold>[1] Courts — Jurisdiction — Challenge — Timeliness.</bold> A challenge to a superior court's subject matter jurisdiction may be made at any time.<page_number>Page 890</page_number> <bold>[2] Civil Procedure — Degree of Compliance — In General.</bold> As a general rule, substantial compliance with the rules and statutes governing civil procedure is sufficient. <bold>[3] Industrial Insurance — Judicial Review — Notice of Appeal —</bold> <bold>Service — Sufficiency.</bold> RCW <cross_reference>51.52.110</cross_reference>, which requires a notice of appeal from a decision of the Board of Industrial Insurance Appeals to be served upon the Director of the Department of Labor and Industries by mail or in person, is satisfied if the director receives actual notice of appeal or if the notice of appeal is served in a manner reasonably calculated to give notice to the director. <bold>[4] Appeal and Error — Review — Matters Not in Record — Effect.</bold> An appellate court should not make factual determinations based upon evidence which was not before the trial court. ROSELLINI and STAFFORD, JJ., concur in the result only.
