A peculiar manner of tithing, arising from immemorial usage, and differing from the payment of one-tenth of the annual increase. To be a good modus, the custom must be, first, certain and invariable; second, beneficial to the parson; third, a custom to pay something different from the thing compounded for; fourth, of the same species; fifth, the thing substituted must be in its nature as durable as the tithes themselves; sixth, it must not be too large, — ^that would MODUS ET CONVENTIO VINCUNT LEgem.
