In civil law. He who leases or lets a thing to hire to another. His duties are, first, to deliver to the hirer the thing hired, that he may use it; second, to guarantee to the hirer the free enjoyment of it; third, to keep the thing hired in good order in such manner that the hirer may enjoy it; fourth, to warrant that the thing hired has not such defects as to destroy its use. In the civil and Scotch laws, a letter; one who lets; he who, being the owner of a thing, lets it out to another for hire or compensation. Story Bailm. § 369; 1 Stair Inst. b. 1, tit. 15, §§ 1, 5, 6. In the land laws, one who locates land, or intends or is entitled to locate. A claim as " locator " signifies that portion of the land located, agreed to be given by the owner of the warrant, as compensation to the locator of it for his services. Hollingsworth v. Barbour, 4 Pet. 466.
