In a criminal case, the state, through a prosecutor, initiates the suit, while in a civil case the victim brings the suit. Persons convicted of a crime may be incarcerated, fined, or both. Criminal defense attorneys represent clients who have been accused of committing a crime, and defend their rights at each stage of a misdemeanor or felony case -- from an arrest to an appeal after conviction. Freeland, originally called Birbeckville after founder Joseph Birkbeck, then South Heberton, is a borough in Luzerne County, Pennsylvania, 18 miles (29 km) south of Wilkes-Barre, and 10 miles northeast of Hazleton in an agricultural region. Freeland was officially incorporated as a borough on September 11, 1876. Coal-mining was a chief industry in the late 1800s and early 1900s. At the turn of the century the population numbered 5,254. By 1910 it had increased to 6,197, and in 1940 it peaked at 6,593 residents. At the 2000 census, the population was 3,643. The current mayor is Tim Martin. Freeland is the highest elevated borough in Pennsylvania at 1,943 feet above sea level.
