Trademark law protects the names, logos, slogans, and other identifiers that businesses use to distinguish their goods and services from those of others. A trademark functions as a source identifier — it tells the public who stands behind a product or service — and trademark law is a branch of intellectual property law focused on protecting that identity and preventing consumer confusion.

Trademark rights generally arise from actually using a mark in commerce, and they can be strengthened by formally registering the mark with a government authority, which provides additional legal advantages. Not every name or phrase can be protected; marks that are distinctive are generally easier to protect, while those that are merely descriptive or generic are weaker or unprotectable. A core concept is the likelihood of confusion: trademark disputes often turn on whether consumers are likely to be confused about the source of goods or services.

Common issues include selecting and clearing a new brand name, registering and maintaining trademarks, licensing brand rights, and addressing infringement — the unauthorized use of a mark in a way that may confuse consumers.
