(a) In addition to any other applicable penalty, the commercial boat registration of a commercial passenger fishing boat may be revoked or suspended by the commission, when requested by the department, for a period not to exceed one year, upon conviction of the registrant, or the registrant’s agent, servant, employee, or any other person acting under the registrant’s direction or control, for a violation of Section 7121 or a regulation adopted pursuant to that section, if the violation in question involves that boat.

(b) In addition to any other applicable penalty, the commercial boat registration of a commercial passenger fishing boat may be revoked or suspended by the commission, when requested by the department, for a period not to exceed one year, upon conviction of any person other than the person specified in subdivision (a), for a violation of Section 7121, if the fish or amphibians involved in the violation were taken from that boat, and the person committing the violation had committed a prior violation of Section 7121 involving that boat within the previous three years.

(c) A commercial boat registration shall not be revoked under this section for a violation committed without the knowledge of the master, or an agent or employee of the registrant.
