Refusal to register or cancellation of registration and licenses

The secretary is authorized and empowered to cancel the registration of any product of commercial fertilizer or soil conditioner or license or to refuse to register any product of commercial fertilizer or soil conditioner or refuse to license any applicant as herein provided, upon satisfactory evidence that the registrant or licensee has used fraudulent or deceptive practices or who willfully violates any provisions of this chapter or any rules and regulations promulgated thereunder: Except no registration or license shall be revoked or refused until the registrant or licensee shall have been given the opportunity to appear for a hearing by the secretary.
1. Upon satisfactory evidence that the registrant or licensee has used fraudulent or deceptive practices or has willfully violated any provisions of this chapter or any rules adopted under this chapter, the secretary is authorized and empowered to do any of the following:
a. Cancel the registration of any product of commercial fertilizer or beneficial substance or license.
b. Refuse to register any product of commercial fertilizer or beneficial substance.
c. Refuse to license any applicant.
2. A registration or license shall not be revoked or refused until the registrant or licensee has been given the opportunity to appear for a hearing by the secretary.
