Penalty — abatement

Whoever is convicted of erecting, causing, or continuing a public or common nuisance as provided in this chapter, or at common law when the same has not been modified or repealed by statute, where no other punishment therefor is specially provided, shall be guilty of an aggravated misdemeanor and the court may order such nuisance abated, and issue a warrant as hereinafter provided.
A person who is convicted of erecting, causing, or continuing a public or common nuisance as provided in this chapter, or at common law when the common law has not been modified or repealed by statute, if no other punishment for the offense is specially provided, shall be guilty of an aggravated misdemeanor. The court may order the nuisance abated and issue a warrant as provided in this chapter.
