Idaho Code § 41-1203

Suits by unauthorized insurer prohibited

1961, ch. 330, § 247, p. 645.

(1) No unauthorized insurer shall institute or file, or cause to be instituted or filed, any suit, action or proceeding in this state to enforce any right, claim or demand arising out of any insurance transaction in this state.

(2) This section does not apply as to: Transactions permitted under section 41-306[, Idaho Code,] (exceptions to certificate of authority requirement).

(3) Coverages exempted from the surplus line law under section 41-1212[, Idaho Code].

(4) Counter claim, cross complaint, or similar action by an insurer in connection with a suit brought against the insurer in which service of process on the insurer was made under the unauthorized insurers process act, sections 41-1204 through 41-1210[, Idaho Code].
