Illinois Hazardous Materials Transportation Act

  • 430 ILCS 30/1— This Act shall be known and may be cited as the "Illinois Hazardous Materials Transportation Act"

  • 430 ILCS 30/4— To the extent necessary to administer this Act, the Department is authorized to: (a) Adopt by reference all or any portion of the Federal Motor Carrier Safety Regulations and the hazardous materials regulations of the United States Department of Transportation, as now or hereafter amended
  • 430 ILCS 30/5— The transportation of hazardous materials in commerce that are not in compliance with this Act or any rules and regulations issued under this Act is prohibited
  • 430 ILCS 30/6
  • 430 ILCS 30/7— This Act shall not apply to: (a) Natural gas pipelines; (b) Transportation by any individual for personal use of any firearm or any ammunition for such firearm; or (c) Transportation of firearms or ammunition in Commerce
  • 430 ILCS 30/8— The Department shall cooperate with other State agencies regulating hazardous materials and may enter into interagency agreements for the purpose of administering or enforcing any provisions of this Act and the rules and regulations issued under this Act
  • 430 ILCS 30/9— (a) The Department is authorized to make and adopt reasonable rules and regulations and orders consistent with law necessary to carry out the provisions of this Act

  • 430 ILCS 30/11— Any person who is determined by the Department after reasonable notice and opportunity for a fair and impartial hearing to have knowingly committed an act that is a violation of this Act or any rule or regulation issued under this Act is liable to the State for a civil penalty

  • 430 ILCS 30/12— Any person who willfully violates any provision of this Act or any rule or regulation issued under this Act is guilty of a Class 3 felony and subject to a fine of not more than $25,000 for each offense

  • 430 ILCS 30/14— Law enforcement officials who regulate transportation over highways shall enforce the rules and regulations issued under this Act
