Uniform Hazardous Substances Act of Illinois

  • 430 ILCS 35/1
  • 430 ILCS 35/2— The following words and phrases shall have the meaning ascribed to them in Sections 2-1 through 2-17
  • 430 ILCS 35/2-1— "Person" means and includes any corporation, association, co-partnership or one or more individuals
  • 430 ILCS 35/2-2— "Director" means the Director of Public Health
  • 430 ILCS 35/2-3— "Department" means the Department of Public Health
  • 430 ILCS 35/2-4
  • 430 ILCS 35/2-5— "Toxic" means any substance (other than a radioactive substance) which has the capacity to produce bodily injury or illness to man through ingestion, inhalation, or absorption through any body surface
  • 430 ILCS 35/2-6
  • 430 ILCS 35/2-7— "Corrosive" means any substance which in contact with living tissue causes destruction of tissue by chemical action; but does not refer to action on inanimate surfaces
  • 430 ILCS 35/2-8— "Irritant" means any substance, not corrosive, which on immediate, prolonged or repeated contact with normal living tissue will induce local inflammatory reaction
  • 430 ILCS 35/2-9— "Strong sensitizer" means any substance which will cause on normal living tissue through an allergic or photodynamic process a hypersensitivity which becomes evident on reapplication of the same substance and which is designated as such by the Director

  • 430 ILCS 35/2-12— "Immediate container" does not include package liners
  • 430 ILCS 35/2-13— "Household use" means any use, or intended use of an article in or about the living area or living quarters of a house, apartment house or other place of abode
  • 430 ILCS 35/2-14— "Radioactive substance" means any substance which emits ionizing radiation
  • 430 ILCS 35/2-15— "Misbranded hazardous substance" means: A

  • 430 ILCS 35/2-17— "Intrastate commerce" means commerce within this State
  • 430 ILCS 35/2-18— An article may be determined to present an electrical hazard if, in normal use or when subjected to reasonably foreseeable damage or abuse, its design or manufacture may cause personal injury or illness by electric shock

  • 430 ILCS 35/2-20— An article may be determined to present a thermal hazard if, in normal use or when subjected to reasonably foreseeable damage or abuse, its design or manufacture presents an unreasonable risk of personal injury or illness because of heat as from heated parts, substances, or surfaces
  • 430 ILCS 35/3— The Director is authorized to make and enforce reasonable rules and regulations for carrying out the provisions of this Act
  • 430 ILCS 35/3a— The Director, when he deems it necessary in the administration of this Act, may require the submission of the names and amounts of any hazardous ingredients in any hazardous substance

  • 430 ILCS 35/4— The Director is authorized to conduct examinations, inspections, and investigations for the purposes of this Act through officers and employees of the Department

  • 430 ILCS 35/7— The Department has power to subpoena and bring before it any person in this State and to take testimony, either orally or by deposition, or both, with the same fees and mileage and in the same manner as prescribed by law in judicial proceedings in civil cases in circuit courts of this State
  • 430 ILCS 35/8— The Department, at its expense, shall provide a stenographer to take down testimony and preserve a record of all proceedings at the hearing of any case under this Act
  • 430 ILCS 35/9— The Department shall make a report of its findings and recommendations
  • 430 ILCS 35/10— All final administrative decisions of the Department hereunder shall be subject to judicial review pursuant to the provisions of the Administrative Review Law, and all amendments and modifications thereof, and the rules adopted pursuant thereto

  • 430 ILCS 35/15— It is the duty of the Department, its officers, agents, inspectors and employees to enforce the provisions of this Act

  • 430 ILCS 35/16a— Substances which are in compliance with the Federal Hazardous Substances Act and the rules and regulations adopted pursuant thereto, and which are not in conflict with this Act and the rules and regulations adopted pursuant thereto, are in compliance with this Act
