Ind. Code § 12-15-5-17

Sec. 17. (a) This section does not apply to a Medicaid recipient participating in the Program of All-Inclusive Care for the Elderly (PACE) program described in IC 12-15-43.

(b) The office may not include a Medicaid recipient who is eligible to:

(1) participate in the Medicare program (42 U.S.C. 1395 et seq.); and

(2) receive nursing facility services;

in a risk based managed care program or capitated managed care program.

(c) This section expires December 31, 2019.
