Sec. 12. (a) A person may not do business as a postsecondary proprietary educational institution in Indiana without having obtained authorization under this chapter.
(b) Upon discovery by the department, the department shall issue a written notice of violation to a person who fails to obtain authorization under this chapter.
(c) A person who receives a written notice of violation under subsection (b) has fifteen (15) days from the date the notice is issued by the department to obtain authorization under this chapter.
(d) If a person described in subsection (c) fails to obtain authorization under this chapter from the department within fifteen (15) days from the date the notice is issued, the department may assess a civil penalty of one hundred dollars ($100) per student who:
(1) attends the subject postsecondary proprietary educational institution; and
(2) resides in Indiana.
(e) Civil penalties collected under this section shall be deposited in the proprietary educational institution authorization fund established by section 39 of this chapter.
