Ind. Code § 34-30-13.5-2

Liability for gross negligence or willful misconduct

As added by P.L.138-2006, SEC.13

Sec. 2. A person described in this chapter is not immune from civil liability if the damages resulting from the act or omission relating to the provision or delay of the health care services resulted from the person's gross negligence, willful or wanton misconduct, fraud, or intentional misrepresentation.
