Ind. Code § 5-10.4-7-12

Recovery of amounts due from school corporation

As added by P.L.2-2006, SEC.28

Sec. 12. (a) If a school corporation fails to make the payments required by this chapter, the amount payable may be:

(1) withheld by the state comptroller from money payable to the school corporation and transferred to the fund; or

(2) recovered in a suit in the circuit or superior court of the county in which the school corporation is located.

(b) The suit described in subsection (a)(2) shall be:

(1) an action by the state on the relation of the board; and

(2) prosecuted by the attorney general.
