(a) There is a Class D beer license.

(b) (1) Subject to paragraph (2) of this subsection, the license authorizes the license holder to sell beer at retail at the place described in the license for on– and off–premises consumption.
(b) (1) Subject to paragraph (2) of this subsection, the license authorizes the license holder to sell beer at retail: (i) at the place described in the license for on–premises consumption; and (ii) at the discretion of the board, for off–premises consumption. (2) A license may not be issued for a drugstore.
