(a) (1) The Advisory Committee consists of 5 members appointed by the Commission with the approval of the Secretary.

(2) Of the 5 members of the Advisory Committee: (i) 2 shall be members of and recommended by the Maryland Horse Breeders Association; (ii) 1 shall be recommended by the mile thoroughbred racing licensees; (iii) 1 shall be recommended by the Maryland State Fair and Agricultural Society, Inc.; and (iv) 1 shall be a member of and appointed by the Commission.
(2) Of the six members of the Advisory Committee: (i) two shall be members of and recommended by the Maryland Horse Breeders Association; (ii) one shall be recommended by the mile thoroughbred racing licensees; (iii) one shall be a member of and recommended by the Maryland Thoroughbred Horsemen’s Association, Inc.; (iv) one shall be recommended by the Maryland State Fair and Agricultural Society, Inc.; and (v) one shall be a member of and appointed by the Commission.
(b) (1) The term of a member of the Advisory Committee is 1 year and begins on June 1.

(2) If the Maryland Horse Breeders Association, the mile thoroughbred racing licensees, or the Maryland State Fair and Agricultural Society, Inc., by June 1 fails to recommend an individual to be a member of the Advisory Committee, the Commission with the approval of the Secretary shall appoint the member.
(2) If the Maryland Horse Breeders Association, the mile thoroughbred racing licensees, the Maryland Thoroughbred Horsemen’s Association, Inc., or the Maryland State Fair and Agricultural Society, Inc., by June 1 fails to recommend an individual to be a member of the Advisory Committee, the Commission with the approval of the Secretary shall appoint the member.
(3) At the end of a term, a member continues to serve until a successor is appointed.
