* § 452. Pending actions or proceedings. This chapter shall not affect\npending actions or proceedings brought by or against the department of\nagriculture and markets or the department of farms and markets, the\ncommissioner of agriculture and markets or the commissioner of farms and\nmarkets, the department of agriculture, the commissioner of agriculture,\nthe department of foods and markets, the commissioner of foods and\nmarkets, the state superintendent of weights and measures, the state\ncommissioner of health, or any other officer, person or corporation, or\nby or in behalf of the people of the state, under or in pursuance of any\nof the provisions of the laws which are to be enforced or carried into\neffect under the provisions of this chapter by the department, but the\nsame may be prosecuted or defended in the same manner and for the same\npurpose by the department, or by the proper officer or party, under the\nprovisions of this chapter. Any investigation, examination or proceeding\nundertaken, commenced or instituted by the department of agriculture and\nmarkets or the department of farms and markets, the commissioner of\nagriculture and markets or the commissioner of farms and markets, the\ndepartment of agriculture, the commissioner of agriculture, the\ndepartment of foods and markets, the commissioner of foods and markets,\nthe state superintendent of weights and measures, the state commissioner\nof health, or any other officer, under the provisions of the laws which\nare to be enforced or carried into effect as provided in this chapter by\nthe department, may be conducted or continued to a final determination\nby the department, commissioner, or other proper officer of such\ndepartment, in the same manner and under the same terms and conditions\nas though this chapter had not been passed.\n * NB Effective until June 15, 2015\n
§ 452. Nourish New York program. 1. The commissioner shall, to the\nextent permitted by state or federal appropriations for such purpose,\nfacilitate programming that ensures surplus agricultural products are\nprovided to food relief organizations at competitive wholesale prices.\n 2. The commissioner shall provide technical assistance and information\nabout the program to food relief organizations, producers of surplus\nagricultural products and the public.\n 3. The commissioner shall provide means, which may include posting on\nthe department's website, for producers to make available surplus\nagricultural products and for food relief organizations to access\nsurplus agricultural products.\n
