Growth, sale, distribution, transportation and processing of hemp and products derived from such hemp permitted

§ 506. Growth of industrial hemp permitted. Notwithstanding any\nprovision of law to the contrary, industrial hemp is an agricultural\nproduct which may be grown, produced and possessed in the state as part\nof an agricultural pilot program pursuant to authorization under federal\nlaw and the provisions of this article.\n Notwithstanding any provision of law to the contrary restricting the\ngrowing or cultivating of industrial hemp, and subject to authorization\nunder federal law, the commissioner may authorize no more than up to ten\nsites for the growing or cultivating of industrial hemp as part of an\nagricultural pilot program conducted by the department and/or an\ninstitution of higher education to study the growth and cultivation of\nsuch hemp provided that the sites used for growing or cultivating\nindustrial hemp are certified by, and registered with, the department.\n
§ 506. Growth, sale, distribution, transportation and processing of\nhemp and products derived from such hemp permitted. 1. Notwithstanding\nany provision of law to the contrary, hemp and products derived from\nsuch hemp are agricultural products which may be grown, cultivated,\nproduced, processed, manufactured, possessed in the state, and sold,\ndistributed, or transported in the state, pursuant to authorization\nunder federal law, the provisions of this article, article\nthirty-three-B of the public health law or any other state law.\n 2. Notwithstanding any provision of law to the contrary restricting\nthe growing or cultivating, processing, manufacturing, sale,\ndistribution or transportation of hemp and products derived from such\nhemp, and subject to authorization of the growth and cultivation of hemp\nunder federal law, the commissioner may: (a) authorize the growing,\ncultivating, processing and manufacturing of hemp as part of\nagricultural pilot programs conducted by the department or an\ninstitution of higher education to study the growth and cultivation,\nsale, distribution, transportation, processing and manufacturing of such\nhemp and products derived from such hemp provided that the sites and\nprograms used for growing or cultivating hemp are authorized by, and\nregistered with, the department; and (b) license the growth and\ncultivation of hemp, including the processing of hemp in connection with\nits growing and cultivation, and the sale of hemp plants or hemp seed.\n
