N.Y. Correct. Law § 23

§ 23. Transfer of inmates from one correctional facility to another;\ntreatment in outside hospitals. 1. The commissioner shall have the power\nto transfer inmates from one correctional facility to another. Whenever\nthe transfer of inmates from one correctional facility to another shall\nbe ordered by the commissioner, the superintendent of the facility from\nwhich the inmates are transferred shall take immediate steps to make the\ntransfer. The transfer shall be in accordance with rules and regulations\npromulgated by the department for the safe delivery of such inmates to\nthe designated facility.\n 2. The commissioner, in his or her discretion, may by written order\npermit inmates to receive medical diagnosis and treatment in outside\nhospitals, upon the recommendation of the superintendent or director\nthat such outside treatment or diagnosis is necessary by reason of\ninadequate facilities within the institution. Such inmates shall remain\nunder the jurisdiction and in the custody of the department while in\nsaid outside hospital and said superintendent or director shall enforce\nproper measures in each case to safely maintain such jurisdiction and\ncustody.\n 3. The cost of transporting inmates between facilities and to outside\nhospitals shall be paid from funds appropriated to the department for\nsuch purpose.\n
