§ 1128-a. * Additional duties of superintendents.\n * NB Effective until June 5, 2019\n * Additional duties of school administrators and superintendents.\n * NB Effective June 5, 2019\n * 1. Where a superintendent of schools forwards to law enforcement a\nreport as described in paragraph (a) of subdivision one of section\neleven hundred twenty-six of this article, he or she shall refer such\nreport to the commissioner where the employee or volunteer alleged to\nhave committed an act of child abuse as defined in this article holds a\ncertification or license issued by the department.\n * NB Effective until June 5, 2019\n * 1. Where a superintendent of schools or, in a school other than a\nschool district or public school, the school administrator forwards to\nlaw enforcement a report as described in paragraph (a) of subdivision\none or subdivision one-a of section eleven hundred twenty-six of this\narticle, he or she shall refer such report to the commissioner where the\nemployee or volunteer alleged to have committed an act of child abuse as\ndefined in this article holds a certification or license issued by the\ndepartment.\n * NB Effective June 5, 2019\n 2. A report which is made pursuant to this article and does not, after\ninvestigation, result in a criminal conviction shall be expunged from\nany record which may be kept by a school or school district with respect\nto the subject of such a report after a period of five years from the\ndate of the making of such report or at such earlier time as such\nschool, or school district, as the case may be, determines.\n
