Information regarding the home energy assistance program for program participants

* § 245. Automated identification of program participants. 1. For the\npurposes of this section, the following terms shall have the following\nmeanings:\n (a) "Office" shall mean the state office of temporary and disability\nassistance.\n (b) "Home energy assistance program" shall mean the low-income home\nenergy assistance program implemented pursuant to section ninety-seven\nof the social services law.\n 2. The department of health shall update the elderly pharmaceutical\ninsurance coverage program application to allow program participants to\nconsent, in a manner that is separate and apart from other requests for\nconsent contained in the application, to the exchange of such\nparticipant's information to verify such enrollee's eligibility for the\nhome energy assistance program. Upon receipt of such consent, the\ndepartment of taxation and finance shall confirm such participant's\nincome at the time of enrollment.\n 3. The department of health shall coordinate with the office to\nfacilitate the secure transmission of data through an interface with the\noffice's information technology infrastructure.\n 4. No less than once per month, the office, upon receipt of the\nrequired data elements from the department of health and the department\nof taxation and finance, as such data elements are defined by the\noffice, shall conduct automated file matching to identify elderly\npharmaceutical insurance coverage program participants who are eligible\nfor the home energy assistance program. Within sixty days of receipt\nthat an elderly pharmaceutical insurance coverage program participant's\neligibility for the home energy assistance program is confirmed, the\noffice shall enroll such elderly pharmaceutical insurance coverage\nprogram participant in the home energy assistance program.\n 5. Upon automatic enrollment in the home energy assistance program,\nthe department of health shall provide written notification to the\nelderly pharmaceutical insurance coverage program participant of their\nenrollment in such program and shall provide information regarding the\nprogram's benefits.\n 6. The office, in consultation with the department of health, is\nauthorized to promulgate any rules and regulations necessary to carry\nout the provisions of this section.\n * NB Effective June 19, 2025\n
§ 245. Information regarding the home energy assistance program for\nprogram participants. 1. For the purposes of this section, the following\nterms shall have the following meanings:\n (a) "OTDA" shall mean the state office of temporary and disability\nassistance.\n (b) "Home energy assistance program" or "HEAP" shall mean the\nlow-income home energy assistance program implemented pursuant to\nsection ninety-seven of the social services law.\n 2. The department of health shall notify program participants and\nprovide information regarding eligibility and how to apply for the home\nenergy assistance program. Such information shall be provided with each\nelderly pharmaceutical insurance coverage paper application that is\ndistributed and also annually to all program participants.\n 3. The department of health shall consult with OTDA and the office on\nthe development of the notification to program participants referenced\nin subdivision two of this section.\n 4. If a participant's household applies for and is enrolled in the\nhome energy assistance program, the applicable local social services\ndistrict shall provide written notification and information to the\nparticipant's household in accordance with OTDA regulations.\n 5. OTDA and the department of health, in consultation with each other,\nare authorized to promulgate any rules and regulations necessary to\ncarry out the provisions of this section.\n
