§ 43-0125. Regulatory and user fees.\n 1. The legislature finds that comprehensive environmental regulatory\nmanagement and conservation within the Lake George park are essential to\nprotect an important part of the environmental resources of the state\nand the public health and welfare. It further declares that regulated\nentities and users of the unique resources of Lake George park should\nbear a significant portion of the costs of regulation, management and\nconservation activities which assure the protection and continued\nbeneficial use of the resources of the park.\n * 2. The following annual fees to be paid to the commission are hereby\nestablished:\n (a) Dock, wharf and mooring fees. The owner of a dock, wharf or\nmooring within the park used for non-commercial residential purposes\nshall pay an annual fee of thirty-seven dollars and fifty cents. The\nowner of a dock or wharf within the park used for commercial purposes\nshall pay an annual fee of three dollars and seventy-five cents per\nlinear foot for each such dock. The owner of a mooring used for\ncommercial purposes shall pay an annual fee of seventy-five dollars for\neach mooring. New docks constructed for commercial use after the\neffective date of this section shall pay a first time fee of seven\ndollars and fifty cents per linear foot and three dollars and\nseventy-five cents per linear foot annually thereafter.\n (b) Boat fees. In addition to the registration required by the state,\nany mechanically propelled boat or vessel with ten horsepower or more\nand any non-mechanically propelled boat or vessel eighteen feet or more\nin length used within the park shall have an annual permit issued by the\ncommission. The fee therefor for boats twenty feet or less in length\noverall shall be thirty dollars; for boats twenty-one to twenty-five\nfeet in length overall, thirty-seven dollars and fifty cents; and for\nboats over twenty-five feet in length overall, thirty-seven dollars and\nfifty cents and seven dollars and fifty cents for each foot by which the\nlength overall exceeds twenty-five feet; for boats over twenty-five feet\nin length overall outfitted for overnight use, thirty-seven dollars and\nfifty cents and thirty dollars for each foot by which the overall length\nexceeds twenty-five feet. The commission may establish a one week use\npermit for eleven dollars and twenty-five cents. The commission may\nestablish a one day use permit for seven dollars and fifty cents for any\nmechanically propelled boat or vessel or nonmechanically propelled boat\nor vessel subject to the annual fee.\n * NB Effective until January 1, 2017\n * 2. The following annual fees to be paid to the commission are hereby\nestablished:\n (a) Dock, wharf and mooring fees. The owner of a dock, wharf or\nmooring within the park used for non-commercial residential purposes\nshall pay an annual fee of fifty dollars. The owner of a dock or wharf\nwithin the park used for commercial purposes shall pay an annual fee of\nfive dollars per linear foot for each such dock. The owner of a mooring\nused for commercial purposes shall pay an annual fee of one hundred\ndollars for each mooring. New docks constructed for commercial use after\nthe effective date of this section shall pay a first time fee of ten\ndollars per linear foot and five dollars per linear foot annually\nthereafter.\n (b) Boat fees. The commission may charge a fee to an applicant for a permit in\norder to recover the costs incurred in reviewing and acting upon an\napplication for such permit.\n 4. Except as otherwise provided by law, all fees collected pursuant to\nthis section shall be deposited to the credit of the Lake George park\ntrust fund pursuant to section ninety-seven-h of the state finance law.\n
