* § 170-h. Additional collection of demographic information. 1. Every\nstate agency, board, department, or commission that directly collects\ndemographic data as to the ancestry or ethnic origin of residents of the\nstate of New York shall use separate collection categories and\ntabulations for the White group in New York state, including the\nfollowing Middle Eastern or North African groups in New York state:\n (a) Each major North African (NA) group, including, but not limited\nto, Egyptian, Moroccan, Algerian, Tunisian, and Libyan; and\n (b) Each major Middle Eastern (ME) group, including, but not limited\nto, Yemeni, Iranian, Palestinian, Iraqi, Lebanese, Israeli, Syrian,\nArmenian, and Saudi; and\n (c) Other Middle Eastern and North African (MENA) groups, including,\nbut not limited to, transnational indigenous MENA communities like\nAmazigh and Syriac people.\n 2. Every state agency, board, department, or commission that directly\ncollects demographic data as to the ancestry or ethnic origin of\nresidents of the state of New York shall allow multiple collection\ncategories to be selected.\n 3. The data collected pursuant to the different collection categories\nand tabulations described in subdivision one of this section, to the\ndegree that the data quality is sufficient, shall be included in every\ndemographic report on ancestry or ethnic origins of residents of the\nstate of New York by the state agency, board, department, or commission\npublished or released on or after December first, two thousand\ntwenty-five; provided, however, that for the department of labor,\ndivision of criminal justice services, office of mental health and\noffice of temporary and disability assistance such requirements shall be\neffective July first, two thousand twenty-six. The data shall be made\navailable to the public in accordance with state and federal law, except\nfor personal identifying information, which shall be deemed\nconfidential, by posting the data on the internet web site of the\nagency, board, department, or commission on or before December first,\ntwo thousand twenty-five, and annually thereafter; provided, however,\nthat for the department of labor, division of criminal justice services,\noffice of mental health and office of temporary and disability\nassistance such requirements shall be effective July first, two thousand\ntwenty-six. If the data quality is determined to be insufficient for\npublication, an explanation of the problem with the data quality shall\nbe included in any report or publication made available to the public.\nThis subdivision shall not be construed to prevent any other state\nagency from posting data collected pursuant to subdivision one of this\nsection on the agency's internet web site, in the manner prescribed by\nthis section.\n 4. The requirements of this section shall not apply to the department\nof labor, the division of criminal justice services, the office of\nmental health or the office of temporary and disability assistance until\ntwo years after this section shall have become a law.\n * NB Effective April 20, 2025\n

The data collected pursuant to the different collection categories\nand tabulations described in subdivision one of this section, to the\ndegree that the data quality is sufficient, shall be included in every\ndemographic report on ancestry or ethnic origins of residents of the\nstate of New York by the state agency, board, department, or commission\npublished or released on or after January first, two thousand\ntwenty-seven. The data shall be made available to the public in\naccordance with state and federal law, except for personal identifying\ninformation, which shall be deemed confidential, by posting the data on\nthe internet web site of the agency, board, department, or commission on\nor before January first, two thousand twenty-seven, and annually\nthereafter. If the data quality is determined to be insufficient for\npublication, an explanation of the problem with the data quality shall\nbe included in any report or publication made available to the public.\nThis subdivision shall not be construed to prevent any other state\nagency from posting data collected pursuant to subdivision one of this\nsection on the agency's internet web site, in the manner prescribed by\nthis section.\n 3. A state agency, board, or commission that cannot comply with the\nrequirements of this section shall, at least sixty days before the\napplicable deadline, post publicly on its web site a written progress\nreport that describes with specificity the steps the agency, board, or\ncommission has taken to comply with this section, the impediments that\nprevented compliance, the efforts undertaken by the agency, board, or\ncommission to come into compliance, and an estimated timeframe for\ncompliance. The written report shall be updated every six months from\nthe date of the original posting.\n * NB Effective July 1, 2026\n
