* § 899-ll. Scope. 1. This article shall apply to conduct that occurs\nin whole or in part in the state of New York. For purposes of this\narticle, commercial conduct takes place wholly outside of the state of\nNew York if the business collected such information while the covered\nuser was outside of the state of New York, no part of the use of the\ncovered user's personal data occurred in the state of New York, and no\npersonal data collected while the covered user was in the state of New\nYork is used.\n 2. Nothing in this article shall be construed to prohibit an operator\nfrom storing a covered user's personal data that was collected pursuant\nto section eight hundred ninety-nine-ff of this article when such\ncovered user is in the state.\n 3. Nothing in this article shall be construed to impose liability for\ncommercial activities or actions by operators subject to 15 U.S.C. 6501\nthat is inconsistent with the treatment of such activities or actions\nunder 15 U.S.C. 6502.\n * NB Effective June 20, 2025\n
