* § 915. Geographical discrimination prohibited. It shall be unlawful\nfor any peer-to-peer car sharing program to engage in any of the\nfollowing practices solely on the basis of the geographical location of\nthe residence of a New York state resident attempting to enter into a\npeer-to-peer car sharing agreement:\n 1. refusing to allow participation in such peer-to-peer car sharing\nprogram provided, however, that a car sharing program may designate\ngeographical boundaries where a car sharing start time or termination\ntime occurs;\n 2. imposing any additional charge for peer-to-peer car sharing of a\nshared vehicle; or\n 3. imposing any additional terms, conditions or privileges upon such\npeer-to-peer car sharing of a shared vehicle.\n * NB Effective March 22, 2022\n
§ 915. Global positioning systems. A peer-to-peer car sharing program\nadministrator shall not use information from any global positioning\nsystem technology to determine or impose any costs, fees, charges, or\npenalties on a shared vehicle driver for such driver's use of a shared\nvehicle. The use of global positioning technology shall not limit the\nright of such peer-to-peer car sharing program administrator to impose\ncosts, fees, charges, or penalties to recover a vehicle that is lost,\nmisplaced, or stolen. The provisions of this subdivision shall not be\nconstrued to modify or supersede any other provision of law.\n
