* § 916. Global positioning systems. A peer-to-peer car sharing\nprogram shall not use information from any global positioning system\ntechnology to determine or impose any costs, fees, charges, or penalties\non a shared vehicle driver for such driver's use of a shared vehicle.\nThe use of global positioning technology shall not limit the right of\nsuch peer-to-peer car sharing program to impose costs, fees, charges, or\npenalties to recover a vehicle that is lost, misplaced, or stolen. The\nprovisions of this subdivision shall not be construed to modify or\nsupersede any other provision of law.\n * NB Effective March 22, 2022\n
§ 916. Notice. In accordance with any applicable federal law or rule,\nevery peer-to-peer car sharing program shall display the following\nnotice prominently and in a clear and conspicuous location on its\nwebsite, with lettering that is legible: "NOTICE: New York State Law\nprohibits the following practices by peer-to-peer car sharing program\nadministrators based upon race, color, ethnic origin, religion,\ndisability, sex, marital status, residence or geographic location,\nincome, sexual orientation, genetic predisposition or age: (1) refusal\nto allow participation in a peer-to-peer car sharing program; and (2)\nthe imposition of any additional charge (except in certain instances\nwhere the shared vehicle driver is under the age of 25). In addition, it\nis unlawful for any peer-to-peer car sharing program administrator to\nrefuse to allow participation in the program to any person solely on the\nrequirement of ownership of a credit card."\n
