Disabilities of firefighters in certain cities caused by cancer

* § 207-kk. Disabilities of firefighters in certain cities caused by\ncancer. Notwithstanding any other provisions of this chapter to the\ncontrary, any condition of impairment of health caused by (i) any\ncondition of cancer affecting the lymphatic, digestive, hematological,\nurinary, neurological, breast, reproductive, or prostate systems or (ii)\nmelanoma resulting in total or partial disability or death to a paid\nmember of a fire department in a city with a population of one million\nor more, who successfully passed a physical examination on entry into\nthe service of such department, which examination failed to reveal any\nevidence of such condition, shall be presumptive evidence that it was\nincurred in the performance and discharge of duty unless the contrary be\nproved by competent evidence. The provisions of this section shall\nremain in full force and effect to and including the thirtieth day of\nJune, two thousand five.\n * NB Expired July 1, 2005\n

Notwithstanding any other provisions of this chapter to the\ncontrary, any condition of impairment of health caused by (i) any\ncondition of cancer affecting the lymphatic, digestive, hematological,\nurinary, neurological, breast, reproductive, endocrine/thyroid or\nprostate systems or (ii) melanoma resulting in total or partial\ndisability or death to a paid member of a fire department in a city with\na population of one million or more, or any retired member of such\ndepartment who has been retired for five or less years, who successfully\npassed a physical examination on entry into the service of such\ndepartment, which examination failed to reveal any evidence of such\ncondition, shall be presumptive evidence that it was incurred in the\nperformance and discharge of duty unless the contrary be proved by\ncompetent evidence. The provisions of this section shall remain in full\nforce and effect pursuant to section four hundred eighty of the\nretirement and social security law.\n * NB Expires per § 480 of the retirement and social security law\n
