Verification of driving history

* § 2327. Verification of driving history. No insurer who utilizes an\napplicant's driving history as a rating or underwriting factor for\nprivate passenger motor vehicle insurance in this state shall bind a\npolicy of insurance, or accept a percentage of the annual premium due\nfor a policy, without first making a good faith effort to verify said\napplicant's driving history, as well as the driving history of all named\ndrivers that are used to rate the policy and are listed by the applicant\non the private passenger motor vehicle insurance application, through\nthe use of a third-party database. An insurer also shall verify, through\na third-party database, the driving history of a named driver used to\nrate the policy when added during the policy period and shall verify the\ndriving history of all drivers used to rate the policy at policy\nrenewal, unless the driving history is unavailable at the time of the\ninitial inquiry due to a temporary website outage, service interruption\nor other circumstances beyond the control of the insurer, producer or\nthird-party representative.\n * NB Effective June 19, 2024\n
§ 2327. Verification of driving history. No insurer who utilizes an\napplicant's New York state driving history as a rating or underwriting\nfactor for private passenger motor vehicle insurance in this state shall\nbind a policy of insurance, or process a percentage of the annual\npremium due for a policy, without first making a good faith effort to\nverify said applicant's New York state driving history, as well as the\nNew York state driving history of all named drivers that are used to\nrate the policy and are listed by the applicant on the private passenger\nmotor vehicle insurance application, through the use of a third-party\ndatabase. An insurer also shall verify, through a third-party database,\nthe New York state driving history of a named driver used to rate the\npolicy when added during the policy period, unless the New York state\ndriving history is unavailable at the time of the initial inquiry due to\na temporary website outage, service interruption or other circumstances\nbeyond the control of the insurer, producer or third-party\nrepresentative.\n
