Transmission of labor market information

§ 12. Transmission of labor market information. 1. For the purposes of\nthis section:\n a. Department means the department of labor of the state of New York.\n b. Commissioner means the industrial commissioner of the state of New\nYork.\n c. Education department means the education department of the state of\nNew York.\n d. Labor market information is defined to include, but not be limited\nto, industry and occupational projections for those standard\nmetropolitan statistical areas for which the department compiles such\ninformation and for the state of New York, "Applications and Openings"\npublication, and the "New York State Annual Planning Report", providing,\nhowever, that the commissioner shall have the power to include\nadditional publications, projections and other data to this definition\nof labor market information.\n 2. When it is jointly determined by the department and the education\ndepartment that labor market information prepared by the department is\nadequate in this prepared form, the department shall transmit a copy of\nsuch information to: every school district in the state of New York\nmaintaining approved career education programs, with a list of such\nschool districts to be furnished to the department by the education\ndepartment; every board of cooperative educational services maintaining\napproved career education programs, with a list of such boards of\ncooperative educational services to be furnished to the department by\nthe education department; and every community college and agricultural\nand technical institute in the state of New York maintaining approved\ncareer education programs, with a list of such colleges and institutes\nto be furnished to the department by the education department. The\neducation department shall regularly update such lists to keep them\ncurrent and transmit changes to the department expeditiously.\n 3. The commissioner shall transmit to those school districts, boards\nof cooperative educational services and community colleges and\nagricultural and technical institutes located within a particular labor\nmarket area, labor market information compiled for that area.\n 4. The transmission of labor market information shall occur as\nfrequently as such labor market information is compiled or published by\nthe department, and in as expeditious a manner as possible following\nsuch compilation or publication.\n 5. If a publication noted by title in this section shall be\ndiscontinued by the department, the department shall transmit, pursuant\nto the provisions of this section, the publication published by the\ndepartment which, in its opinion, provides the information most similar\nto that information which had previously been provided by the\ndiscontinued publication.\n 6. If a publication noted by title in this section shall have such\ntitle changed, the department shall continue to transmit such\npublications with its new title.\n 7. When the department and the education department jointly determine\nthat labor market information prepared by the department, to be\ntransmitted pursuant to this section, requires an explanatory analysis\nto be utilized to its fullest potential, the education department shall\nprovide an analysis of the information, written in clear, concise and\neasily understandable language. Such analysis shall consider, but not be\nlimited to a consideration of, the following: instructions for the\nproper use of such information by individuals involved in the planning\nand development of career education, the proper use of such information\nby individuals involved in vocational and educational guidance, and the\nproper use of such information by current and prospective career\neducation pupils in the selection of career education programs likely to\noffer the greatest potential for employment upon graduation.\n 8. To effectuate the purposes of this section, the commissioner and\nthe commissioner of education, or their authorized designees, shall meet\non a regular basis which shall not be less than once a month, excepting\nJuly and August when such meeting shall be discretionary.\n 9. It shall be the responsibility of such school districts, boards of\ncooperative educational services, and community colleges and\nagricultural and technical institutes in receipt of such publications\nand sources of labor market information enumerated in this section to\nprovide copies of such labor market information to those individuals\nresponsible for vocational and educational guidance at such school\ndistricts, boards of cooperative educational services, community\ncolleges and agricultural and technical institutes.\n

Forward-facing employment data is defined to include, but not be\nlimited to, current and projected employment opportunities in the state\nof New York, and shall include, but not be limited to, factors such as\ngeographical location or required training and experience for such\nopportunities.\n 2. When it is jointly determined by the department and the education\ndepartment that labor market information or forward-facing employment\ndata prepared by the department is adequate in this prepared form, the\ndepartment shall transmit a copy of such information and data to: every\nschool district in the state of New York maintaining approved career\neducation programs, with a list of such school districts to be furnished\nto the department by the education department; every board of\ncooperative educational services maintaining approved career education\nprograms, with a list of such boards of cooperative educational services\nto be furnished to the department by the education department; and every\ncommunity college and agricultural and technical institute in the state\nof New York maintaining approved career education programs, with a list\nof such colleges and institutes to be furnished to the department by the\neducation department. If a publication noted by title in this section shall be\ndiscontinued by the department, the department shall transmit, pursuant\nto the provisions of this section, the publication published by the\ndepartment which, in its opinion, provides the information most similar\nto that information which had previously been provided by the\ndiscontinued publication.\n 6. If a publication noted by title in this section shall have such\ntitle changed, the department shall continue to transmit such\npublications with its new title.\n 7.
