N.Y. Lab. Law § 715

§ 715. Application of article. The provisions of this article shall\nnot apply to: (1) employees of any employer who concedes to and agrees\nwith the board that such employees are subject to and protected by the\nprovisions of the national labor relations act or the federal railway\nlabor act; or (2) employees of the state or of any political or civil\nsubdivision or other agency thereof.\n
