* § 953. License and permit procedure. All applications for elevator\ncontractor's, elevator mechanic's, and elevator inspector's licenses and\nrequired permits shall be submitted to the department in writing on\nforms furnished by the commissioner and shall contain the information\nset forth in this section as well as any additional information that the\ncommissioner may require. The commissioner shall also set fees for\nlicensing and permitting under this section.\n 1. Applications for licenses. Every application for a license under\nthis article shall include the following:\n (a) the name, residence address and business address of the applicant;\n (b) the number of years the applicant has engaged in the business or\npractice of designing, constructing, erecting, installing, inspecting,\ntesting, repairing, altering, maintaining, or servicing conveyances\ncovered by this article;\n (c) the approximate number of persons, if any, to be employed by the\napplicant for an elevator contractor's license;\n (d) evidence that the applicant is or will be covered by general\nliability, personal injury and property damage insurance; and\n (e) any other information which the commissioner may require.\n Upon approval of an application for a license the commissioner shall\nissue such license which shall be valid for two years. The fees for such\nlicense and renewal thereof shall be set by the commissioner. Any denial\nfor such application shall set forth the reasons therefor.\n 2. Application for permits. Every application for a permit under this\narticle shall include plans and specifications stamped and signed by a\nprofessional engineer and/or an architect licensed pursuant to article\none hundred forty-five and/or article one hundred forty-seven of the\neducation law. Every application for a permit under this article shall\ninclude the following:\n (a) copies of the specifications and accurately scaled and fully\ndimensioned plans showing the location of the installation in relation\nto the plans and elevation of the building;\n (b) the location of the machinery room and the equipment to be\ninstalled, relocated or altered;\n (c) all structural supporting members thereof, including foundations;\n (d) a list of all materials to be employed and all loads to be\nsupported and conveyed;\n (e) any other information that the commissioner may require to ensure\nthat such plans and specifications are sufficiently complete and\nillustrate all details of construction and design;\n (f) any required permitting fees, which are subject to return upon\ndenial of a permit application; and\n (g) the department shall maintain and publish a registry of all\nlicensed elevator mechanics, contractors and inspectors, which shall\nlist and identify, all licensed elevator mechanics, contractors, and\ninspectors doing business in this state. The department shall make the\nregistry available on its website.\n Upon approval of an application for a permit the commissioner shall\nissue such permit. Such permit shall state the time by which the work\nshall commence and also when such permit expires. If after the work has\nbeen started, work is suspended or abandoned for a period of sixty days,\nor such shorter period of time as the commissioner may specify at the\ntime the permit is issued, the permit shall expire. Upon expiration of a\npermit for which work has not been completed, the commissioner may\nextend such permit.\n 3. Licensing and permitting exemptions. Whenever an emergency exists\nin this state due to a disaster or act of God, which imperils the\nhealth, safety or welfare of an individual or individuals and placing\nsuch individual or individuals in imminent danger of injury or death and\nthe number of persons in the state holding licenses granted by the board\nis insufficient to cope with such emergency, any person certified by a\nlicensed elevator contractor to have an acceptable combination of\ndocumented experience and education to perform elevator work without\ndirect and immediate supervision shall seek an emergency elevator\nmechanic's license from the commissioner within five business days after\ncommencing work requiring a license. The commissioner shall issue\nemergency elevator mechanic's licenses to address the emergency that\nexists. The licensed elevator contractor shall furnish proof of\ncompetency as the commissioner may require. Each such license shall\nrecite that it is valid for a period of fifteen days from the date\nthereof and for such particular elevators or geographical areas as the\ncommissioner may designate to address the emergency situation and\notherwise shall entitle the licensee to the rights and privileges of an\nelevator mechanic's license issued in this article. The commissioner\nshall renew an emergency elevator mechanic's license during the\nexistence of an emergency as needed. No fee shall be charged for any\nemergency elevator mechanic's license or renewal thereof.\n 4. Restricted license. A restricted class of lift mechanic license\nshall be known as "accessibility technician". Such class of license\nshall be restricted to performing work involving platform lifts\nincluding those installed in private residences which are covered by the\nprovisions of ASME (American society of mechanical engineer) codes and\nstandards A18.1-2005. An applicant for such restricted license shall\ncomplete an application approved by the board and shall have at least\nthree years verified work experience in constructing, maintaining and\nrepairing those lifts covered by ASME A18.1-2005 and shall provide to\nthe commissioner a certificate of completion of an accessibility\ntraining program for lifts under the scope of A18.1-2005 such as the\ncertified accessibility training provided by the national association of\nelevator contractors, or an equivalent program as deemed by the\ndepartment.\n * NB Effective and Repealed January 1, 2022\n * § 953. Every application for a\nlicense under this article shall include the following:\n (a) the name and residential address of the applicant;\n (b) the relevant experience of the applicant, including years, or\nhours, or both, of experience in performing elevator and conveyance\nwork, or elevator inspection work, or both and the nature of such\nexperience, and the names of the elevator contractors or elevator\ninspection contractors that the applicant has worked for, including the\nlicense numbers of such contractors;\n (c) any training completed by the applicant, including certificates of\ncompletion;\n (d) any continuing education completed by the applicant, including\ncertificates of completion;\n (e) the name and license number, if known, of the elevator contractor\nor elevator inspection contractor that the applicant works for or seeks\nto work for; and\n (f) any other information which the commissioner may require.\n 3. The department shall maintain and publish a registry of all\nlicenses issued pursuant to this section and shall make the registry\navailable on its website.\n * NB Effective January 1, 2022\n
