N.Y. Penal Law § 220.71

§ 220.71 Criminal possession of methamphetamine manufacturing material\n in the first degree.\n A person is guilty of criminal possession of methamphetamine\nmanufacturing material in the first degree when he or she commits the\noffense of criminal possession of methamphetamine manufacturing material\nin the second degree, as defined in section 220.70 of this article, and\nhas previously been convicted within the preceding five years of\ncriminal possession of methamphetamine manufacturing material in the\nsecond degree, as defined in section 220.70 of this article, or a\nviolation of this section.\n Criminal possession of methamphetamine manufacturing material in the\nfirst degree is a class E felony.\n
