§ 248. Racing season; allotment of dates for racing. In the assignment\nof dates by the state racing and wagering board to corporations for\nconducting running races or steeplechases no conflict shall be deemed to\nexist by reason of duplication of dates as between race meetings in the\nfirst zone and race meetings in the second zone, nor as between race\nmeetings within a zone if the race courses at which such meetings are\nheld are at least thirty-five miles apart in the first zone and at least\nseventy-five miles apart in the second zone, except that a minimum of\nthirty-six days of racing shall be assigned exclusively to the second\nzone unless the governor determines that a sufficient emergency exists\nfor reducing such number of days of racing, in which event the state\nracing and wagering board is then authorized to assign a lesser number\nof days of racing to the second zone. The state racing and wagering\nboard may separately apportion to the several corporations licensed or\nfranchised to conduct running races or steeplechases as many of the\nracing days for the season, not to exceed the maximum number of racing\ndays permitted by law.\n

In the assignment\nof dates by the commission to corporations for conducting running races\nor steeplechases no conflict shall be deemed to exist by reason of\nduplication of dates as between race meetings in the first zone and race\nmeetings in the second zone, nor as between race meetings within a zone\nif the race courses at which such meetings are held are at least\nthirty-five miles apart in the first zone and at least seventy-five\nmiles apart in the second zone, except that a minimum of thirty-six days\nof racing shall be assigned exclusively to the second zone unless the\ngovernor determines that a sufficient emergency exists for reducing such\nnumber of days of racing, in which event the commission is then\nauthorized to assign a lesser number of days of racing to the second\nzone. The commission may separately apportion to the several\ncorporations licensed or franchised to conduct running races or\nsteeplechases as many of the racing days for the season, not to exceed\nthe maximum number of racing days permitted by law.\n
