§ 312. Special policemen. 1. For the purpose of preserving order and\npreventing offenses against the laws prohibiting gambling, the officers\nor directors of any corporation or association created under or subject\nto the provisions of sections two hundred twenty-two through seven\nhundred five of this chapter are hereby authorized to appoint from time\nto time, special policemen, and the same to remove at pleasure, who,\nwhen appointed, shall be peace officers with the same powers within and\nabout such grounds as are vested in peace officers as set forth in\nsection 2.20 of the criminal procedure law, whose duty and powers, when\nappointed, shall be to preserve order within and around the grounds and\nracetracks of said corporation or association, to protect the property\nwithin said grounds, to eject or arrest all persons who shall be\nimproperly within the grounds of such corporation or association or who\nshall be guilty of disorderly conduct, or who shall neglect or refuse to\npay the fees or to observe the rules prescribed by said corporation or\nassociation; and it shall be the further duty of said policemen, when\nappointed to prevent all violations of law with reference to\npool-selling, bookmaking, and other gambling, and to arrest any and all\npersons violating such provisions, and to convey such person or persons\nso arrested, with a statement of the cause of such arrest, before a\ncourt having jurisdiction of such offense, to be dealt with according to\nthe law. The appointment of policemen in pursuance of this section shall\nnot be deemed to supersede in any wise on the grounds and racetrack of\nsuch corporation or association the authority of peace officers or\npolice officers of the jurisdiction within which such grounds and\nracetrack are located.\n 2. Any appointment of a special policeman under this section shall\nonly be made with the approval of the state racing and wagering board.\nApplication for such approval shall be in such form as may be prescribed\nby the board and shall contain such other information or material or\nevidence as the board shall require. In acting on an application for\nsuch approval the board shall consider the background, experience,\nintegrity, and competence of the candidate for appointment, the public\ninterest, convenience or necessity and the interests of harness racing\ngenerally. The board in its discretion may set the term of any such\nappointment, terminate any existing appointment at any time and\nprescribe conditions and rules for the conduct of such office.\n

The appointment of police officers in\npursuance of this section shall not be deemed to supersede in any wise\non the grounds and racetrack of such corporation or association the\nauthority of peace officers or police officers of the jurisdiction\nwithin which such grounds and racetrack are located.\n 2. Any appointment of a special police officer under this section\nshall be made only with the approval of the commission. Application for\nsuch approval shall be in such form as may be prescribed by the\ncommission and shall contain such other information or material or\nevidence as the commission shall require. In acting on an application\nfor such approval the commission shall consider the background,\nexperience, integrity, and competence of the candidate for appointment,\nthe public interest, convenience or necessity and the interests of\nharness racing generally. The commission in its discretion may set the\nterm of any such appointment, terminate any existing appointment at any\ntime and prescribe conditions and rules for the conduct of such office.\n
