§ 412. Special policemen. 1. For the purpose of preserving order and\npreventing offenses against the laws prohibiting gambling, the officers\nor directors of any corporation or association created under or subject\nto the provisions of this article are hereby authorized to appoint from\ntime to time, special policemen, and the same to remove at pleasure,\nwho, when appointed, shall be peace officers with the same powers within\nand about such grounds as are set forth in section 2.20 of the criminal\nprocedure law whose duty, when appointed, shall be to preserve order\nwithin and around the grounds and racetracks of said corporation or\nassociation, to protect the property within said grounds, to eject or\narrest all persons who shall be improperly within the grounds of such\ncorporation or association or who shall be guilty of disorderly conduct,\nor who shall neglect or refuse to pay the fees or to observe the rules\nprescribed by said corporation or association; and it shall be the\nfurther duty of said policemen, when appointed to prevent all violations\nof law with reference to pool-selling, bookmaking, and other gambling,\nand to arrest any and all persons violating such provisions, and to\nconvey such person or persons so arrested, with a statement of the cause\nof such arrest, before a magistrate having jurisdiction of such offense,\nto be dealt with according to law. The appointment of policemen in\npursuance of this section shall not be deemed to supersede in any way on\nthe grounds and racetrack of such corporation or association the\nauthority of peace officers or police officers of the jurisdiction\nwithin which such grounds and racetrack are located.\n 2. Any appointment of a special policeman under this section, shall\nonly be made with the approval of the state racing and wagering board.\nApplication for such approval shall be in such form as may be prescribed\nby the board and shall contain such other information or material or\nevidence as the board shall require. In acting on an application for\nsuch approval the board shall consider the background, experience,\nintegrity, and competence of the candidate for appointment, the public\ninterest, convenience or necessity and the interests of quarter horse\nracing generally. The board in its discretion may set the term of any\nsuch appointment, terminate any existing appointment at any time and\nprescribe conditions and rules for the conduct of such office.\n

The appointment of police officers in pursuance of\nthis section shall not be deemed to supersede in any way on the grounds\nand racetrack of such corporation or association the authority of peace\nofficers or police officers of the jurisdiction within which such\ngrounds and racetrack are located.\n 2. Application for\nsuch approval shall be in such form as may be prescribed by the\ncommission and shall contain such other information or material or\nevidence as the commission shall require. In acting on an application\nfor such approval the commission shall consider the background,\nexperience, integrity, and competence of the candidate for appointment,\nthe public interest, convenience or necessity and the interests of\nquarter horse racing generally. The commission in its discretion may set\nthe term of any such appointment, terminate any existing appointment at\nany time and prescribe conditions and rules for the conduct of such\noffice.\n
