N.Y. Surr. Ct. Proc. Act § 1120

§ 1120. Appearance by consuls\n 1. In any action or proceeding brought by or against a public\nadministrator in which a non-domiciliary noncitizen is a necessary or\nproper party the consular representative of the country of which the\nnoncitizen is a citizen or subject may appear in person or by attorney\nin behalf of the noncitizen if the latter shall default in appearance.\n 2. No power of attorney or other specific authority from the\nnoncitizen shall be required as a condition to such appearance.\n 3. Service upon a noncitizen pursuant to 307, subdivision 3, paragraph\n(e) may be made without prior service of process personally or otherwise\nupon the noncitizen.\n 4. The interests of noncitizen persons under disability shall,\nhowever, be represented in all such proceedings by their guardians of\nthe property, committee of the property or conservators of the property,\nor by guardians ad litem appointed by the court.\n
