(1) Except as otherwise provided in this section, a person who violates a provision of this chapter shall be assessed a civil penalty of not more than $1,000.00.

(2) A person who operates as a precious metal dealer without the certification required by section 3882 of this title shall be: for a first offense, imprisoned for not more than six months or fined not more than $10,000.00, or both;
