Notwithstanding ss. 227.11 (2) , 227.24 (1) (a) and 563.04 (3) , the department may not promulgate any emergency rule relating to the commingling of bingo and raffle receipts unless it can clearly establish that commingling will occur without such rule and that the rule will effectively prevent commingling. The department shall set forth any such finding in its proposed rule. If upon review under s. 227.40 , the court finds that the finding of fact upon which any emergency rule relating to such commingling is based is unsupported by clear and convincing evidence, the rule is invalid.
The department may not promulgate any rule relating to the commingling of bingo and raffle receipts.
